The recent case of Raj v Capita BS is an interesting one. Raj was dismissed and complained of sexual harassment by Ward, their line manager.Ward used to stand behind Raj in an open plan office and give them a massage on their back, neck and shoulders often lasting for two or three minutes. Raj never asked for the massage and Ward claimed that they did it to "encourage" Raj.The Court held that this did not amount to sexual harassment and dismissed Raj's claim.It is easy to assume that Raj was female and Ward male. However in fact the genders were the other way around.I wonder if the Court would have come to the same conclusion if Raj had been female and Ward male?
